Is Loli/Shota allowed here? It's technically illegal. I deleted my stashes all a long time ago out of paranoia.
My stance on the matter has always been that I have nothing against loli or people who are into it, but I prefer it not be shared on this site to play it safe in terms of legality.
>>28736 They'd have to raid your house to bust you anyway. So unless you're getting cops in your house you're safe. You'd think they'd have their hands full with just real cp. Then again, there's a case from Swedistan where a guy got jailed for having too extensive a doujin collection. No idea how they got him.
I would be fine with it, but then again,my name and address are not attached to the servers. Also the map is inaccurate, because the US constitution allows loli and shota under free speech, so even if yo are charged, it would take the world's most ineffectual lawyer to not get that overturned. I am in a state in red, and have bought doujinshi hard copy in another adjacent state in red, with underage characters, and nobody has had an issue.
>my name and address are not attached to the servers. Neither are mine, but I'm paranoid what can I say?
Again with this faulty map. >Prohibits computer-generated child pornography when "(B) such visual depiction is a computer image or computer-generated image that is, or appears virtually indistinguishable from that of a minor engaging in sexually explicit conduct"; (as amended by 1466A for Section 2256(8)(B) of title 18, United States Code). Japan has a similar setup. >Prohibits drawings, sculptures, and pictures of such drawings and sculptures depicting minors in actions or situations that meet the Miller test of being obscene, OR are engaged in sex acts that are deemed to meet the same obscene condition. The law does not explicitly state that images of fictional beings who appear to be under 18 engaged in sexual acts that are not deemed to be obscene are rendered illegal in and of their own condition (illustration of sex of fictional minors). The Miller test is here: https://en.wikipedia.org/wiki/Miller_test "Ashcroft vs. Free Speech Coalition" clarified the previously ambiguous law. Loli and shota is legal in all 50 states, although ignorance could lead to erroneous prosecutions.
I understand it is as being kind of a legal grey area, and I've never been able to get a straight answer as to the actual legal status of it. I think in practical terms it's like >>28740 said, the FBI probably has its hands full dealing with more serious crime and is unlikely to spend much time and effort investigating it. Considering 4chan/b/ has round the clock threads on the subject and I'm pretty sure the FBI is well aware of the existence of that board at this point, I'd say it's not a subject that law enforcement considers high priority one way or the other. My guess is that viewing that sort of material and saving it on your computer is probably pretty low risk, although if cops happened to raid your house for something similar like CP and found lolicon they might try to charge you with something. If you're really paranoid your best bet would probably be to create an encrypted container on a flash drive and then just keep the flash drive hidden somewhere when you're not using it.
>>28733 So if you draw a murder of underaged fictional character, that's legal. But if you draw a underaged fictional character doing it, you go to jail. That's USA for you.
>>38419 >if you draw a underaged fictional character doing it, you go to jail No, not really. In the US, that's not the case. People have been arrested who just so happened to also have loli, or they've been arrested for importing a lot of physical media. I've never read a case about an artist being arrested.
>>38419 Not really no. We have a lot of fucked laws but loli/shota is in a strange gray area and prosecution for it is exceedingly rare. People have been arrested crossing the border into Canada with it though.
The legal grey area of it sometimes bothers me, but I do things that are more commonly prosecuted like extensive piracy and it doesn't as much. The law on it changing is sometimes what haunts me though. I'm not a lolicon, but I do enjoy /ss/ even though for me it's more about the height difference and penis size. That map is either bait or severely outdated as well, Canada is known for enforcing their laws on this. (But if you rape a native woman, you're good).
